Arla draws up new model tenancy agreement

The Association of Residential Letting Agents has finalised a new model tenancy agreement covering regulations intended to benefit landlords and tenants.

This follows the interpretation and guidance on the impact the Unfair Terms in Consumer Contracts Regulation issued by the Office of Fair Trading in May 2001.

It includes four tests to measure standard tenancy agreements for fairness.

These are, is the clause written in plain, intelligible English? is it misleading or have the potential to mislead the tenant over legal rights? does it impose disproportionate or unfair penalties on the tenant? does it create significant imbalance in rights and obligations, to the detriment of the tenant?
