HMRC could offer "get out of jail free" card to fraudsters

HMRC could promise not to criminally prosecute tax fraudsters in exchange for an admission of guilt and full disclosure of their tax affairs, under proposals from the Revenue.

The proposal, called a contractual disclosure facility was laid out in a consultation paper published by HMRC earlier this week.

It says: “Under the proposed CDF, HMRC would contact the taxpayer in writing telling then they were suspected of tax fraud and offering them the opportunity to enter into a contract to disclose that fraud in exchange for certainty that HMRC would not carry out an investigation.”

The contract would require tax fraud suspects to admit fraud, disclose all known irregularities, entities affected and parties involved, an give indication of the amounts involved. The CDF would not exempt people from paying duties, interest or penalties.
